Mercy makes the Website available for your lawful, noncommercial, personal use, limited to general information and educational purposes only and grants you a limited, revocable, nonexclusive license to access and use this Website for your personal use. You may not use the Website in a manner that impairs or harms the Website, Mercy, or other users of the Website. No part of this Website may be reproduced, or otherwise exploited for commercial purposes.

As a result, in order to access some information, products, services or websites you may be required to accept additional terms, or additional terms may be presented to or made available to you. The additional terms will supersede, modify, or supplement these Terms. To the extent that such information, product, service or website is provided by a third party, Mercy assumes no responsibility for such third party information, products or services and you acknowledge that Mercy is not responsible for the accuracy or other aspects such third party information, products or services. All software, content, and the compilation of all content, included on this Website is the property of Mercy or its licensors and is protected by copyright laws. The Mercy Health logo is a registered trademark of Mercy. The product and service names profiled herein are proprietary marks of Mercy. All other brands and names are the property of their respective owners.

7. We will comply with the Digital Millennium Copyright Act 

If you have any copyright concerns about materials posted on the Website, you agree to let Mercy know. What Information Do We Collect?

Mercy automatically collects certain information from your device when you visit the Website. This information includes information about:

Mercy uses third party service providers, including but not limited to Google Analytics, Adobe Analytics, and cookies in order to improve our service, user experience, and to analyze how the website is used. Aside from your device's Internet Protocol address (IP address), which can disclose your general location, the information collected by Google Analytics and Adobe Analytics is anonymized traffic data including length of stay on the Website, browser information, and device information. The collected information is used to provide an overview of how people are accessing and using the Website. What About International Privacy Laws?

Mercy only offers services within the United States, and the Website is only intended to be used by users in the United States. By visiting the Website, you consent to the transfer of your information to the United States and the use and disclosure of your information as described in this Privacy Policy. Furthermore, you consent to the exclusive jurisdiction of the United States for purposes of any question of law or fact related to your use or access to the Website.

With Whom Do We Share Personal Information?

Our Service Providers. Subject to any applicable limitations stated in the Notice of Privacy Practices, we may share your personal information with companies (including our affiliates) that perform services on our behalf, for example, companies that help process credit card payments. Our service providers are required by contract to protect the confidentiality of the personal information we share with them and to use it only to provide specific services on our behalf.

What About Third Party Sites or Applications?

In accessing our Website you may access portions which contain functions or content licensed by third parties.  How such third parties collect, use and share personal information that they collect about you or that you provide to them is solely governed by such third party and any applicable license terms, terms of use or privacy policy. We are not responsible for the content or privacy practices of external internet sites or applications and recommend that you read the privacy policy of external sites and applications before disclosing any personal information.

Security

While we do our best to protect your personal information, we cannot guarantee the security of any information that you transmit to us and you are solely responsible for maintaining the secrecy of any passwords or other account information.

COPPA Compliance

The Website is not directed at children under the age of 13. We comply with the Children's Online Privacy Protection Act (“COPPA”) and do not knowingly permit registration or submission of personally identifiable information by anyone under 13 years of age. If you believe information of a child under 13 has been submitted, please advise us in writing and we will delete it.

California Do Not Track Notice

Websites and cookies can track your movements on the Internet to better tailor suggestions for you based on your interests. However, some people do not want their browsing behavior to be tracked. As noted above, we do not track your movements on the Website over time or across third party websites to provide targeted advertising and therefore do not respond to Do Not Track (DNT) signals. At registration and at various times as you use the Website, you will have the option of receiving regular newsletters, email or Short Message Service (SMS) texts (electronic communications) with personally identifiable informational (PII) or promotional newsletters (Promotional Materials). While we do not charge fees to receive text messages, message and Data Rates from your wireless carrier may apply. Any costs incurred as a result are your responsibility. Messages may come from Mercy directly and/or from third parties on our behalf.

You may elect to receive electronic communications through a variety of methods including, but not limited to express statements in which you provide your email address or mobile telephone number in order that we can contact you to communicate information such as test results or appointment reminders, or through general consents where you provide your contact information for general correspondence related to our ongoing relationship with you as a healthcare provider. By providing your mobile number, you agree to receive voice and electronic communications by voice and text and by providing your e-mail address you agree to receive e-mail and agree that the that the device(s) and account(s) that will receive the electronic communications are appropriately secured. If you wish to stop receiving text messages at any time you may do so by simply responding STOP to any text message from us. For additional assistance, email texthelp@mercy.net.

This Privacy Policy (“Policy”) sets forth the guidelines defining how we, Mercy Health (“we” or “us”) use and protect the information you (“you”) provide to us when you use the MyMercy services, either through the MyMercy application and/or access MyMercy via the internet, including all tools, services, content and information available on or through the application and website. We reserve the right to modify this Policy from time to time. By using MyMercy you signify your assent to this Policy. If you do not agree to this Policy, please do not use MyMercy. Your continued use of MyMercy following the posting of changes to this Policy means you accept those changes.
 

This Policy supplements the Notice of Privacy Practices (“NPP”) available here which governs our access, use and disclosure of your protected health information, as well as our website’s general Terms of Use and Privacy Policy available here. To the extent that information contained in MyMercy is protected health information (“PHI”), then our access, use and disclosure of PHI will be managed consistent with the NPP. To the extent a conflict exists between this Policy and the NPP, then the NPP shall be given priority.
 

The tools, features and services available through MyMercy include (1) access to electronic health information (“EHI”), (2) access to health education information, (3) access to telehealth services, and (4) tools for communicating with participating physicians, other licensed health care professionals (“Providers”) and other individuals engaged in your care in real time, via live video, telephone and/or secure email, for the diagnosis and treatment of patients over the Internet. MyMercy allows you to view and pay for healthcare services.  All of these tools, features and services are referred to together as “Services.” Your ability to access Services is dependent on the Services ability to maintain a secure connection with you and to access certain functions on your device such as the camera, speaker, light, microphone and Bluetooth functionality.
 

When you use the Services, you may provide us with different types of information, including personal information you knowingly choose to share with us and information that you permit your device to share with us. By using or accessing the Services, you may provide us with additional information about you that facilitates use of the Services or ensures the privacy and security of information available through the Services. You may see an in app notice when we access or request access to certain information or functionality on your device. We may use the personal information you provide to us when we interact with you, for our own internal business purposes, in a de-identified and aggregated form or to improve the function of the Services.
 

We may store and process any information you enter into the Services together with other information we hold about you (i.e. as a component of your medical record) or independently as a user of the Services. It is completely optional for you to use the Services and to provide us your information through the Services. Although the Services may allow you to access your EHI or the EHI of another individual who has given you proxy access, EHI does not by default reside in the Services.
 

You may utilize functionality within MyMercy to download EHI to your device that may be accessible by MyMercy or extract data from MyMercy to other third party applications.  You are solely responsible for ensuring the privacy and security of any information you download or extract from or through MyMercy. For example, at your request, we may provide you with access to a copy of your medical records and the results of certain tests that you upload into a personal health record or you may request that we provide a copy of your medical records to a personal health record. 
 

If you provide a cell number to receive information, you consent to receiving SMS and MMS automated text messages from us. You may opt-out of receiving such messages at any time by modifying your communication preferences. Messages may be sent at various times on an ongoing basis. Message and data rates may apply. Consent to receive text messages is not required as a condition of purchasing any goods or services.
 

We receive and store certain types of information whenever you use the MyMercy, through the use of "cookies." A "cookie" is an element of data that a website or mobile app can send to your computer or smartphone, which may then be stored on your device and used to provide you with tailored information. We use cookie information to analyze how frequently MyMercy is being used or viewed, for automatic user recognition, and to improve your overall MyMercy experience with us.
 

You may request to communicate through secure messaging with your physician/health care provider or our billing or customer support services.  If you choose to correspond further with us through texts, email, or through the secure messaging feature, we reserve the right to retain the content of your messages and communications (including video content), together with your contact information, including IP addresses, device information and other meta data as well as email address(es), and our responses.
 

The Services utilize features, functionality and content powered by third parties (e.g. Microsoft, Apple, Google as well as home health monitoring device manufacturers, etc.). Please be aware that features, functionality and content provided by third parties and accessed through MyMercy may also collect personally identifiable information about you. Use of these features and content is subject to the then-current versions of such third party’s terms of use and privacy policies. Third party features, functionality and content is provided as a convenience to you and Mercy does not provide any endorsement of such third party or the apps, website, products or services it sells or terms pursuant to which such items and services are made available. The information practices of those third parties are not covered by this Policy.
 

When permitted by your device settings, third party functionality may operate in the background and collect information about you, even when the MyMercy is not running.  You are responsible for reviewing such third party terms of use and privacy policies which may be subject to change without notice. Mercy has no control over third party terms of use and privacy policies and is not responsible for third party terms of use and privacy policies.

MyMercy may interact with your sensitive data to provide certain features, such as video visits or mobile appointment check-in. The first time you try to use any of these features, we will ask for your consent within the app and will only allow you to use a feature if you give consent. You do not have to provide consent if you do not want to allow MyMercy to interact with your data as requested. MyMercy is developed by Epic Systems Corporation; please refer to Epic’s Mobile Application Privacy Policy for Patients for more detailed information about the limited ways they may interact with your information to make your use of MyMercy possible.
 

MyMercy may offer location-based check-in for in-person appointments or allow you to find healthcare providers near you. The first time you try to use any features that use your location, we will ask for your consent within the app and will only access your location if you give consent. You do not have to provide consent if you do not want to allow MyMercy to use your location. We do not store your location data.
 

No data transmission over the Internet can be guaranteed to be 100% secure. While we strive to protect your information from unauthorized access, use or disclosure, we do not warrant the security of any information you elect to transmit to us through the Service.

1. MyMercy MFA is a program that will send a one-time use verification code via SMS that you enter while logging into MyMercy. This extra layer of security helps ensure that you’re the only person who can log in to your account, even if someone else knows your username and password.
2. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, please follow instructions on your account settings page to activate SMS, and we will start sending SMS messages to you again.

4. Carriers are not liable for delayed or undelivered messages.

SOCIAL MEDIA DISCLAIMER 

Mercy reserves the right to moderate comments on its social media platforms and may remove any content including advertising, profanity or offensive posts, as well as any off-topic commentary.

When you sign up for text messages from Mercy through your Electronic Health Record (Epic), you are signing up to receive text messages related to your relationship with Mercy, including updates related to your visits, MyMercy account, one-time passcode, billing notifications, prescription reminders, and care management.

You can opt out of SMS messages by texting STOP to the respective shortcode. Your opt-out request will generate one final message confirming that you have been unsubscribed. You will no longer receive SMS messages from the shortcode you opted out from. If you want to join again, sign up using MyMercy or text HELP to the shortcode for instructions.
